DETERMINED BOUNDARIES

Application to determine the precise location of a boundary must be made using Land Registry Form DB which can be downloaded from their website (http://www.landregistry.gov.uk).The application must be accompanied by a plan identifying the exact line of the boundary claimed and evidence to establish that the exact line of the boundary is in the position shown on that plan. The registrar must be satisfied that the plan supplied identifies the exact line of the boundary and that the applicant has shown an arguable case that the boundary is in the position shown on the plan. If the registrar is not satisfied as to either of the above points he must cancel the application. The applicant must supply the names and addresses of all adjoining owners. If any of the adjoining land is unregistered,the applicant must supply copies of the adjoining owner’s title deeds. If the registrar is not satisfied he can identify the owners of all the land adjoining he must cancel the application. The registrar must give notice of the application to all adjoining owners, unless the written agreement of an adjoining owner to the application has been lodged. An application to the registrar to determine the exact line of the boundary should not be used to try and resolve a boundary dispute.
